Right of Withdrawal / Cancellation Policy and Model Withdrawal Form for the PartySpot App

1. Scope
This cancellation policy applies to the chargeable digital products acquired by distance selling through the mobile app “PartySpot” (iOS/iPadOS and Android) by a consumer (Verbraucher, § 13 of the German Civil Code / Bürgerliches Gesetzbuch, BGB). Chargeable features are provided exclusively through one-off in-app purchases (consumable purchases); there are neither subscriptions nor recurring payments. These include in particular:
- Party tiers (Party-Tiers / Party-Stufen): Free-Sample, Mini, Normal, Big, Mega and Admin-Unlimited,
- stackable storage add-ons (expansion of PartySpot Storage),
- Party Recap (Party-Recap).
Each individual in-app purchase is a separate distance contract; this cancellation policy is therefore satisfied for each purchase transaction, not just once upon installation.

3. Cancellation Policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (SZuCO – Dr.-Ing. Piotr Szegvári, Zum Weizenring 14, 14469 Potsdam, Germany, email: info@partyspot.app) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). For this purpose, you may use the withdrawal function provided in the app (“Withdraw from contract”) or the attached model withdrawal form, although the latter is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.
4. Withdrawal Function in the App (§ 356a BGB)
We provide within the app a withdrawal function (the “Withdraw from contract” button) that is permanently available, clearly visible and easily accessible throughout the entire withdrawal period. After you activate it, you reach a confirmation page on which you can enter your name, the contract to be withdrawn from (identification of the purchase) and a means of communication for the acknowledgement of receipt; you complete the withdrawal with a separate “Confirm withdrawal” button. We will confirm receipt of your withdrawal declaration to you without undue delay on a durable medium (dauerhafter Datenträger), stating the content of the declaration as well as the date and time of receipt; this acknowledgement of receipt makes no statement as to the effectiveness of the withdrawal. For anonymous purchasers who do not maintain an account with an email address, we make the withdrawal function available without an account and enable the acknowledgement of receipt via another durable medium.
In addition, you may declare your withdrawal directly to us at any time by email to info@partyspot.app or by letter to the address stated above.
5. Early Expiry of the Right of Withdrawal for Digital Content (§ 356(5) BGB)
In the case of a contract for the supply of digital content not supplied on a tangible medium — in particular party tiers and Party Recap (cf. Section 7) — your right of withdrawal expires early only if
a) you have expressly consented to our beginning performance of the contract before the expiry of the withdrawal period, and
b) you have confirmed your knowledge that, by giving your consent, you lose your right of withdrawal upon the commencement of performance of the contract, and
c) we have provided you with a confirmation of the contract pursuant to § 312f BGB on a durable medium, which expressly evidences your consent to the early commencement of performance and your knowledge of the loss of the right of withdrawal.
We obtain these two declarations (consent and acknowledgement of knowledge) before performance begins, in two separate, active and non-pre-selected steps within the app’s own interface; they are placed upstream of the platform-controlled purchase process (Apple/Google). If unlocking occurs without all of the foregoing conditions having first been obtained, or if the service is free of charge, your fourteen-day right of withdrawal remains in full force.
For digital content, in the event of an effective withdrawal you owe no compensation for value (Wertersatz) (§ 357a(3) BGB).
6. Early Expiry of the Right of Withdrawal for Digital Services (§ 356(4) BGB)
Insofar as the acquired service constitutes a digital service — in particular storage add-ons with ongoing provision of storage space (cf. Section 7) — the right of withdrawal expires only upon the complete provision of the service, and only if you have expressly consented to our beginning performance before the expiry of the withdrawal period and have confirmed your knowledge that you lose your right of withdrawal upon complete performance of the contract.
If you exercise your right of withdrawal after having given the foregoing consent, a proportionate compensation for value (Wertersatz) may be owed for the service rendered up to the point of withdrawal (§ 357 BGB).
7. Classification of Product Types
For the application of Sections 5 and 6, the following applies:
- Party tiers and Party Recap are digital content within the meaning of § 356(5) BGB (no compensation for value, Section 5).
- Storage add-ons that provide storage space on an ongoing basis over a period of time may be classified as a digital service within the meaning of § 356(4) BGB (Section 6).
In the respective purchase transaction, you are shown the cancellation policy applicable to the specific service.
8. Note on Processing via the Platform (Apple/Google)
The acquisition and payment processing of the in-app purchases take place via the in-app purchase systems of the respective platform (Apple App Store or Google Play Store). Since payment processing takes place via the platform, the technical refund may be made via the system of the respective platform operator. This does not affect your statutory claim for reimbursement and withdrawal directed against us.
You may assert your statutory rights of withdrawal directly against us at any time — via the in-app withdrawal function (Section 4) or by notification to info@partyspot.app. We accept and process the withdrawal ourselves. In addition, the platform operators (Apple/Google) offer their own refund processes; making use of these is an additional, voluntary avenue and does not curtail your statutory rights against us.
