Legal Notice / Site Notice (Provider Identification)

Provider identification pursuant to Sec. 5 DDG (Digitale-Dienste-Gesetz / German Digital Services Act) and Sec. 18 MStV (Medienstaatsvertrag / German Interstate Media Treaty) for the mobile application PartySpot (iOS and Android). No web version is offered.

1. Provider

This provider identification also serves to fulfil the general legal-notice obligation under Sec. 18 (1) MStV, since the offering does not serve exclusively personal or family purposes (commercial offering, monetised via in-app purchases; no advertising, no subscription).

In addition to the email address, we provide a second, rapid means of communication for direct and efficient communication within the meaning of Sec. 5 (1) No. 2 DDG (telephone number or in-app contact form with a guaranteed short response time).

3. Value Added Tax

Value added tax identification number pursuant to Sec. 27a UStG (German VAT Act): DE458930351 No business identification number pursuant to Sec. 139c AO exists.

4. Supervisory Authority / Professional Regulatory Information

No special official authorisation is required to operate PartySpot; there is no competent supervisory authority within the meaning of Sec. 5 (1) No. 3 DDG for the activity offered. Insofar as supervision should nevertheless be relevant in an individual case:

5. Person Responsible within the Meaning of Sec. 18 (2) MStV

Relevant only insofar as journalistic-editorial content is offered:

PartySpot essentially conveys user-generated content (party gallery, comments, music voting) and does not provide its own journalistic-editorial content within the meaning of Sec. 18 (2) MStV; this information is therefore omitted as long as no such content is offered.

6. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Sec. 36 (1) No. 1 VSBG / German Consumer Dispute Resolution Act).

Note on EU online dispute resolution (ODR platform): The European Commission discontinued its online dispute resolution platform (ODR platform) effective 20 July 2025; it has been unavailable since then. A link to this platform is therefore no longer possible and no longer required. Our contact details listed under Section 2 remain available for any concerns without change.

7. Liability for Content

As a service provider, we are responsible for our own content on this application in accordance with the general laws pursuant to Sec. 7 (1) DDG. However, pursuant to Secs. 8 to 10 DDG, we as a service provider are not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate unlawful activity.

PartySpot is a platform for user-generated content: hosts and guests independently upload photos and short videos to the shared party gallery and may contribute comments as well as music suggestions. This content is not reviewed by us in advance. Obligations to remove or block the use of information under the general laws remain unaffected by this. However, liability in this respect is only possible from the point in time at which a specific infringement of the law becomes known. Upon becoming aware of corresponding infringements, we will remove such content immediately.

Third-party music and storage services: Playback takes place via the locally installed Spotify app (App Remote SDK) or Apple Music (MusicKit) and thus via the respective host’s premium account; we do not offer our own streaming. Selectable storage locations for media are PartySpot Storage (Firebase) or a host’s own connected cloud account (Dropbox, Google Drive). We assume no liability for the availability, the content, and the terms of these third-party services; their respective terms apply in addition.

Our offering may contain links to external third-party websites over whose content we have no influence. We therefore cannot assume any warranty for this third-party content. The respective provider or operator of the pages is always responsible for the content of the linked pages. The linked pages were checked for possible legal violations at the time of linking; unlawful content was not discernible at the time of linking. Permanent monitoring of the content of the linked pages is not reasonable without concrete indications of a legal violation. Upon becoming aware of legal violations, we will remove such links immediately.

The content and works created by the provider in this application (e.g. user interface, texts, graphics, logos) are subject to German copyright law. Reproduction, processing, distribution, and any kind of exploitation outside the limits of copyright law require the prior written consent of the provider.

For content contributed by users (in particular photos, videos, and comments in the party gallery), the rights lie with the respective author or rights holder. Such content is marked or identifiable as submitted by third parties. Should you nevertheless become aware of a copyright infringement, we ask that you notify us accordingly using the contact details listed under Section 2. Upon becoming aware of legal violations, we will remove such content immediately.
